By the time of accession, adapt national procurement rules, as appropriate, to allow the conduct of national competitive bidding and international competitive bidding procedures for NATO security investment programme (NSIP) projects in line with NATO procedures

  • Slovenian procurement rules have been aligned with EU legislation. They allow for exceptions in case of:
    • conduct of bidding procedures for common implementation or use of projects by the countries bound by an international agreement;
    • conduct of bidding procedures in case of an agreement on stationing of troops;

  • Special rules apply to the conduct of bidding procedures in case of purchasing armaments, military equipment, special operative technology or other confidential procurement.

  • MoD has internal rules on procedures in confidential cases to safeguard the principles of competitiveness and transparency of the bidding procedures, and to ensure the economical use of budgetary funds.

Adapt national budget regulations, as appropriate, to provide for the payment of contributions to NATO common funded budgets and programmes and to provide for the operation and maintenance of NSIP accounts

  • Slovenia will contribute to NATO's common funded budgets and programmes and for the operation and maintenance of NSIP accounts in the existing structure of the State Budget.

  • No adaptation of national budget regulations is needed to provide for the payments of contributions to NATO common funded budgets and programmes. Technically such payments are carried out through the current and capital transfers abroad.

Adapt national tax regulations, as appropriate, to facilitate NATO's tax exempt functioning

  • The Constitution states (Art. 8) that laws and regulations must comply with generally accepted principles of international law and with international treaties. It further provides for the ratified and published treaties to be applied directly.

  • Therefore the exemption from VAT and excise duty for NATO forces is currently implemented directly.

  • VAT Act and Excise Duty Act will be amended in 2003 to align the national tax legislation with European tax standards. They will include special provisions about the tax exemption for NATO, its International Staff and International Military Staff members and NATO forces in Slovenia as a host country.

  • The amendments are expected to come into force upon the accession to the EU (1 May 2004).

Set up a national NSIP office

  • Slovenia will set up a national NSIP office that will interface with NATO Commands, the International Staff and NATO Committees on NSIP projects by the end of 2003. The office will be responsible for the preparation of Capability Packages and project submissions and for project follow-up and NSIP accounting. It will be established within the Office of Logistics in MoD.

  • The staff of the Slovenia's NSIP Office will be able and qualified to conduct all the necessary procedures regarding NSIP activities.

  • The Office of Logistics will continue to work closely with the logistics branch of the SAF General Staff and will also establish relevant co- operation in the field of NSIP.
